DAWN HOUSE BED WARRANTIES
2-YEAR HASSLE FREE | Your bed is warranted against defects in materials or workmanship for two years from the date of purchase to the original purchaser. During such time, we will repair or replace any warranted part found to be defective by the manufacturer, at its sole discretion.
5-YEARS ON PARTS | During years 3 through 5 from the original purchase date, Dawn House will replace any part on the adjustable base found to be defective, to the original Purchaser. The manufacturer’s liability is limited to the replacement of the defective electrical/ mechanical parts* ONLY with the purchaser responsible for all service, installation, and transportation cost of said parts.
1-YEAR PARTS & LABOR WARRANTY FOR DAWN HOUSE HEALTH SENSORS |
Your adjustable base has a one year, full replacement on
parts, labor and transportation on the health sensors should your health sensors fail during the first year of this warranty from the original purchase date. This warranty covers the functionality of the health sensors for their normal, intended use as specified in the Owner’s Manual and does not cover a malfunction that has resulted in improper or unreasonable use or maintenance, or accident.
TERMS & CONDITIONS | This warranty does not include reimbursement for inconvenience, removal, part(s) installation, bed set up, loss of use, normal wear and tear, shipping or any other costs or expenses not expressly covered in this warranty. In addition, this warranty shall be void in the following circumstances:
- Damage resulting from misuse or abuse caused by the Purchaser or any third party.
- Damage caused by repairs or parts replacement by an unauthorized person.
- Damage caused if the adjustable base has been mishandled (including during shipping), subject to physical abuse or an improper power supply, or by failing to adhere to the Owner’s Manual and this warranty.
- Damaged mattresses, foundation cover(s), fabric(s), bedding cables, electrical cords or accessories supplied by dealers or any third party. Contact your dealer for warranty information on these items.
- Modification of the adjustable base without prior written consent by the manufacturer.
- Costs for unauthorized service calls for the purpose of educating the consumer about the adjustable base or locating proper functioning power outlets.
ADDITIONAL TERMS & CONDITIONS |
- Damage if the recommended weight restrictions are exceeded
- Damage if used in any environment or a commercial setting which was not intended
- Damage to foam shroud by improper handling or misuse.
PARTS | Based on the terms of the warranty, parts and service will be provided either at no cost or at a prorated fee.
*Parts include the following:
- Head/Foot Actuator
- Massage Motors and Housing
- Control Box
- Remote Control, Power Cord, Power Supply, and Input Cord
- Mounting Brackets
- Support Struts.
OTHER THAN AS EXPRESSLY SET OUT HEREIN, AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER ORAL OR WRITTEN WARRANTIES, REPRESENTATIONS, CONDITIONS OR PROMISES, WHETHER EXPRESS OR IMPLIED, AND WHETHER ARISING BY LAW, STATUTE, COURSE OF DEALING OR USAGE OF TRADE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, QUALITY, DURABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT PERMITTED BY APPLICABLE LAWS, ANY IMPLIED WARRANTIES (IF APPLICABLE) ARE LIMITED IN DURATION
TO THE DURATION OF THIS WARRANTY. TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE MANUFACTURER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, CONSEQUENTIAL, LIQUIDATED OR SIMILAR DAMAGES, WHETHER OR NOT FORESEEABLE.
To the extent permitted by law, this warranty is not transferable and will automatically terminate if the original Purchaser sells or otherwise disposes of the adjustable base.
This warranty gives the Purchaser specific legal rights. Other rights, which vary from jurisdiction to jurisdiction, may exist. In addition, some jurisdictions do not allow (i) the exclusion of certain warranties, (ii) limitations on how long an implied warranty lasts and/or (iii) the exclusion or limitation of certain types of costs and/or damages, so the above limitations may not apply.
This warranty is only valid in The United States, Canada and Puerto Rico. For all other jurisdictions, this Limited Product Warranty is valid only in the jurisdictions where the Products are sold by an Ergomotion authorized reseller or agent and is valid to the extent permitted by the applicable laws of such jurisdictions.
WEIGHT LIMITS | This product is not rated to support weights in excess of 750 pounds for Queen/Full sizes and 450 pounds for TL sizes. This product is not rated to support weights in excess of this weight inclusive of the mattress and bedding. The base will structurally support this weight, provided it is evenly distributed across the bed base. The adjustable base is not designed to support or lift this amount in the head or foot sections alone. Exceeding this weight restriction could damage the bed and/or cause injury and will void the warranty.
DAWN HOUSE MATTRESS LIMITED 10-YEAR WARRANTY
MATTRESS 10-YEAR WARRANT | Dawn House warrants that this product is free from defects in workmanship and materials and will remain serviceable under normal use and service for the limited warranty period, from the date of delivery to the consumer, subject to specific limitations and expectations subsequently set forth in the limited warranty.
This limited warranty covers any deterioration in the cell-structure of the material that causes the mattress to have a visible indentation greater than three-fourths (3/4) of an inch, not associated with a sag in the foundation, slats, box springs, or platform. It also covers any physical flaw in the mattress that causes the material to split or crack despite normal usage and proper handling. Should the product develop defects for reasons other than misuse or neglect within the limited warranty period, Dawn House guarantees that this mattress will be replaced or repaired at our option, without cost to you, should it be deemed defective because of faulty workmanship, or structural defects, excluding the specific limitations contained herein.
The cover is warranted to be free from defective materials or workmanship for two (2) years from the date of purchase, under normal care and use. The limited warranty does not include fading, pilling, or shrinkage and is not valid where there is evidence of soiling or unsanitary conditions.
In the event identical materials are not available to be used in the replacement or repair for product, we the manufacturer, reserve the right to substitute other materials of equal or greater quality. The customer is responsible for returning the product to the manufacturer. All transportation costs are the responsibility of the purchaser. Proof of purchase and the date of manufacture of the product are required. The law label on the product will serve as a means of establishing the date of manufacturer. Removal of the law label will void this limited warranty. A receipt, or canceled check, or other acceptable documentation can serve as proof of purchase.
This limited warranty is valid only to the original purchaser of the product. You must provide proof of purchase for any limited warranty claim. Warranties are made only to the original retail purchaser and do not cover merchandise purchased or used, secondhand, or distressed.
All warranties contained herein shall not apply if the product or cover has been physically damaged, burned, cut, torn or is abnormally soiled or unsanitary. The manufacturer reserves the right to refuse service when the product is found to be stained, soiled, in unsanitary conditions or when product failure is due to cause of misuse or abuse. These warranties do not cover normal wear and tear.
The limited warranty does not apply under the following conditions and circumstances:
- If the product is found to be unsanitary.
- When product failure is due to causes other than defective workmanship or materials.
- If the mattress is used on a frame or bed rails without a continuously solid support surface.
- If there is damage to the outer fabric of the cover including wear and tear.
- If this product is used for commercial purposes.
- If purchaser does not produce proof of purchase.
- If the purchaser finds the mattress does not meet their comfort preference.
- The mattress is designed to work on a firm, solid-surface, on a bed base that is structurally capable of supporting the weight of the mattress and user(s). This mattress warranty does not cover your mattress if you use it in a manner incompatible with that intended design.
Dawn House does not warrant against mold. Please note that visco memory foam, latex foam and polyurethane foam should never get wet or be kept in an environment with excessively high humidity.
Dawn House does not warrant that this mattress is suitable for any medical conditions or that it will protect the user against bacteria, viruses or other organisms.
Dawn House does not warrant against normal increases in softness of the foam material or a decrease in the elasticity of the foam material. Normal use will result in signs of routine aging. Slight body impressions may appear in the normal course of use, and some changes may occur in the support characteristics. This indicates your bedding is adjusting to your body to enhance comfort and should not be considered a manufacturer defect.
Failure to follow the manufacturer’s use and care instructions may void the limited warranty. All implied warranties shall be limited to the period of this limited warranty unless otherwise required by applicable federal or state law. Some states do not allow limitations on how long a limited warranty lasts, so consequently, the limitations may not apply.
Order Cancellations
Because NewLeaf strives to deliver customer orders as quickly as possible, most orders are processed and shipped the day they are ordered. Orders that are cancelled after they have shipped are subject to any applicable manufacturer restocking fees, return shipping and original shipping costs as outlined below.
Orders that have been paid for by credit card, debit card, or PayPal may be subject to the non-recoverable 3.5% processing fee that is assessed by the credit card company when a transaction is processed.
Returns & Exchange Policy
Your satisfaction as our customer is our top priority, and we want you to be completely satisified with your purchase. Because many of the items offered at NewLeaf Home Medical are considered "Medical Devices," there are a few strict guidelines that need to be followed for medical compliance and hygenic reasons.
Non-Returnable Items
There are certain products that are inherently Non-Returnable due to the nature of the product, sterile/hygienic concerns, or for custom-built reasons. The following products if the product has been put into use: Mattresses; Mattress Pads; Bath Lifts; Bathroom Safety Products; Bedding Products. Items NOT eligible for return if the product packaging has been opened include, but are not limited to: Products classified as a "Medical Device" by the manufacturer or the FDA (Food & Drug Administration); Case Pack items; Contour Products (pillows, body positioners, etc.); and MOXI and Prius Mattress products. Mattress or Bathroom products that have been put into use are NOT eligible for return. Custom or Made-to-Order items NOT eligible for return include, but are not limited to: Recliners from Winco, Lumex, and some Pride Lift Chairs; Beds from Big Boyz Beds, Dawn House, Dynarex, Flexabed, Med-Mizer, and Transfer Master; and Mattresses from *Flexabed, Med-Mizer, Moxi Mattresses, and Transfer Master. Recliners are Non-Returneable if they have been unboxed and/or assembled, which includes but is not limited to: Drive Medical, Dynarex, Invacare, Lumex (Made-to-Order models are not returnable under any circumstances), Pride (Made-to-Order models are not returnable under any circumstances), and Winco (Made-to-Order models are not returnable under any circumstances). Patient Lift products are Non-Returneable, which include, but are not limited to: BestCare, Drive Medical, Invacare, Traxx Mobility, Protekt, and Lumex. *Flexabed mattresses may be exchanged for another mattress type within 30 days. Shipping fees an packing costs will apply. Mattresses must be returned in New condition.
Restocking & Shipping Fees
The standard restocking fee for many, but not all, items sold at NewLeaf Home Medical is 20%. However, the following supplier-sourced items are subject to restocking fees that are dictated by the manufacturer: Contour Products *Non-Returnable if product packaging has been opened, otherwise (25%); Drive Medical (25%); Dynarex (20%); Flexabed (20%); Lumex/Graham Field (25%); Invacare (25%); Pride Lift Chairs (25%); Prius (20%); Protekt Mattresses (25%); Rhythm Healthcare *20 Day return policy (20%); and Traxx Mobility (25%).
While many of our products are offered with "Free Shipping," the actual incurred ship-to costs cannot be recouped from the shipping company once your item has shipped. As a result, this cost will be deducted from your eligible return refund. Original shipping costs may be waived if exchanging for another item of same or greater value.
Orders that were paid for by credit card, debit card, or PayPal may be subject to a non-recoverable 3.5% processing fee that was assessed by the payment processor when your transaction was processed.
Return Shipping
Return shipping costs are the responsibility of the customer unless the return item(s) was damaged during shipment to you, the item you received was not what you ordered, or the return is due to a warranty issue.
Return Timeframe & Requirements
You have 30 calendar days to return an item from the date you received your order *If your item is not classified as a "Non-Returnable" item, or the manufacturer stipulates a different return window period. It is IMPORTANT to note that:
Items must be returned in New, Unused and Resalable Condition.
Return items must be shipped back in the original shipping carton with manufacturer retail packaging. *Manufacturers will not grant return authorization if the original box and packaging has been discarded because the retail packaging is necessary to be able to resell the merchandise as "New."
Medical devices like Feeding Tubes, Catheters, Oxygen Tubing/Masks, Bathroom, Bedding or Mattress products, and other items with "hygienic" classifications are only eligible for return if the item packaging is unopened and unused.
